The Children’s Health Defense (CHD), an organization advocating against vaccines and led by Robert F. Kennedy Jr., has once again been unsuccessful in its attempts to persuade a court that Meta functioned as a governmental entity while regulating the group’s content on platforms such as Facebook and Instagram.
In a ruling supporting an earlier decision, Judge Eric Miller of the US Ninth Circuit Court of Appeals stated that CHD did not provide sufficient evidence to demonstrate that Meta was acting on behalf of the government during its censorship practices. He emphasized that Meta’s authority to restrict content deemed “offensive” is safeguarded by First Amendment rights, ultimately rejecting CHD’s requests for both an injunction and financial damages.
“Evidently, Meta upholds the belief that vaccines are not only safe but should also be promoted,” Judge Miller noted in his opinion. “The company retains the right to advocate for these views merely because they align with those held by government officials.”
